UNIVERSITY OF MILAN: MRS. SIMONA LAVAGNINI WILL SPEAK AT THE CONFERENCE “INDUSTRIAL LITIGATION, CROSS-BORDER AND BEFORE THE UNIFIED PATENT COURT” ON MAY 25, 2023

We are pleased to inform you that, on May 25th, Mrs. Lavagnini will intervene – as speaker and as President of AIPPI Gruppo Italiano – during the third session (2.30-4.30 p.m.) of the conference “Industrial litigation, cross-border and before the Unified Patent Court”, organised at the University of Milan, Via S. Antonio n. 5, Aula N. 3.

 

The event will take place throughout the day of Thursday, May 25th, 2023, from 9.30 a.m. to 7 p.m. The third session – “Copyright and Related Rights Litigation in the Digital Single Market” – will see as speaker, among others, Mrs. Simona Lavagnini, founding partner of LGV Avvocati.
The event is accredited by the Milan Bar Association with the attribution of 5 training credits, it will be held in presence only and will require, due to the limited number of places, registration through the appropriate form by May 24th, 2023.


MUSIC, WHEN THE AI “STEALS” THE VOICE OF SINGERS: WHAT SAFEGUARDS?

Agenda Digitale published a rich and interesting contribution by Simona Lavagnini, founding partner of LGV Avvocati, on a very topical issue of vital importance for the future of the music and cultural industry: what risks does the use of AI in the production of artistic works bring? What safeguards have been put in place to date for authors and for the various subjects involved in the production chain of the cultural industry?

 

The issue presents numerous critical and uncertain profiles, both with reference to the concrete risk of imitation and falsification of works and performances – as, for example, in the case of the song “Heart On My Sleeve”, misattributed to the singer Drake – and with regard to the use of works for the training of AI generative models. Mrs. Lavagnini’s article therefore focuses on the various and different aspects of the matter, addressing the issue of transparency in the use of others’ works by AI in order to define the applicative boundaries of the text & data mining exception and the related opt-out right, as well as the more than legitimate considerations regarding the protection of performers’ personality rights – especially in situations where AI even mimics their voice or image, without their prior consent. Finally, in light of the very low production costs of AI-generated works, an important question remains about the future and survival of the traditional cultural industry.

OPEN SOURCE SOFTWARE LICENCES: THE ISSUES RELATED TO NON-PERFORMANCE AND PRODUCT LIABILITY

We are happy to share a new interesting contribution by Mrs. Simona Lavagnini, founding partner of LGV Avvocati, on the matter of licenses for the use of commercial and open source software, with specific reference to the profiles of non-performance liability in the light of the most recent case-law and legislative approaches.

 

What application can be reserved to clauses in software licenses that provide broad exemptions from liability for total, partial or incorrect performance? What differences could there be when the supplier is a “non-professional”? The subject remains widely debated, both in the Italian Supreme Court’s jurisprudence and in the doctrine, with particular reference to the treatment to be reserved to the world of open source, also and above all looking at the text – not yet final – of the proposal for a European Directive on product liability.

An important recognition for Mrs. Simona Lavagnini, included among the “TOP 250 women in IP” in the 2023 IP STARS rankings.
