TANKRED THIEM PROMOTES MILAN AS CANDIDATE FOR THE CENTRAL DIVISION OF THE UNIFIED COURT AT THE DIJV CONGRESS

On 7-9 October 2016, the annual congress organized by the “Vereinigung für den Gedankenaustausch zwischen deutschen und italienischen Juristen e.V.” and its sister company the “Association for cultural exchanges between Italian and German jurists” was held – in complete bilingualism – in Munich, Germany. The congress took place in the comfortable EPO hall in Munich, with the participation of German lawyers, judges and university professors and with patent law being one of the central topics of the event.


 

Yet again the most heated debate concerned the effects of BREXIT on the new unified system of European patent law and the Unified Patent Court. While on the one hand several issues were brought to light by the interpretation of the treaty and of European Regulations, on the other hand what was discussed was the feasibility of those approaches that nevertheless try to include the UK in the scope covered by the unitary title, thus ensuring that the extent of jurisdiction of the future Tribunal will also reach beyond the Channel. In the discussions and debates that follow several possibilities and political and legal implications were discussed, and specifically that of assigning to Milan the section of the central division of the Unified Court, originally given to London. In that regard, the order of Italian consultants had already invited the national Government to take a formal stand on the point (cfr: http://www.ordine-brevetti.it/categoria/comunicazioni-iscritti/name/candidatura-di-milano-a-sede-del-tribunale-unificato-dei-brevetti). The agreement establishing a Unified Court places peculiar attention on the number of validated patents as well as the number of ongoing proceedings, as relevant factors for the choice of location where to allocate the sections of the Court. It is undeniable that Italy – after Germany and France, where the other two sections of the central division have been assigned to – is the State with the highest number of convalidated European patents. The debate ended with the statement, no longer disputed, that the city of Milan would be the most realistic and suitable choice for the section originally assigned to London. This also confirms what had already been stated by several Germany professionals who participated at the AIPPI Conference in Milan in September 2016. The colleagues had the opportunity to visit and see Milan and consider the potential offered by the Court of Milan with its modern adjacent structures.

SIMONA LAVAGNINI AT THE SEMINAR ON VALORIZING, MANAGING AND DEFENDING INTELLECTUAL PROPERTY

Next 27 September 2016 Ms. Simona Lavagnini will participate at the round table discussion “Valorizing, managing and defending Intellectual Property” organized by “The ruling companies association”. The event will be held at the Lombardy Industrial Association Congress in Milan.


 

The meeting is intended to provide small and medium sized Italian companies, known to be highly creative and innovative, with the necessary information and instruments to valorize and protect their ideas. Ms. Lavagnini will engage with the other participants and will speak of her own extensive professional experience in assisting technology companies, providing support in the development phase of ideas as well as in the stage involving registration and protection of IP assets.

SIMONA LAVAGNINI IN BOLOGNA FOR THE AIPPI SEMINAR ON THE UNIFIED PATENT COURT

The name partner Ms. Simona Lavagnini, as President of the Formation Group of AIPPI Italia, will participate at the seminar “Analysis of the procedures of the Unified Patent Court” organized by the AIPPI Italian Group. The event will be held on June 29, 2016, in Bologna, within the evocative setting of Fornace Galotti “Battiferro”, where the Museum of Industrial Heritage is located.


 

The seminar will focus on an analysis of the various legislative innovations concerning the rise of a unified patent system, and will represent an occasion to specifically deal with issues such as territorial competence, first degree trials and the procedure related to the non-infringement declaration before the Unified Patent Court.

The introduction of a new “Unified Patent” and of the Unified Court is particularly topical at the moment and presents complexities and elements of uncertainty which have now come to the forefront, particularly in light of the recent British referendum, seeing as Great Britain, one of the States that most contributed to the birth of the new system and that should have hosted the division competent to deal with cases connected to chemistry, pharmaceuticals and biotechnologies, has decided to leave the European Union. What will happen to the Unified Court?


SIMONA LAVAGNINI WILL BE A SPEAKER AT THE AIPLA-AIPPI INTERNATIONAL SEMINAR

On June 17, 2016, the name partner of LGV, Ms. Simona Lavagnini, will be speaking at an international seminar “New Trends in IP Legislation and Legal Procedures: a Comparison between US and Europe”, that has been jointly organized by the European Practice Committee of AIPLA (American Intellectual Property Law Association), the Order of Industrial Property Consultants, the Italian group AIPPI (International Association for the Protection of Intellectual Property) and AICIPI (Italian Association of Consultants and Experts in Industrial Property of Entities and Companies).


The seminar will focus on an analysis of the latest US legislation and case law concerning trademarks and patents, specifically with reference to patentability of software, means-plus-function claim interpretation, trade secrets, designs and trademarks. Ms. Simona Lavagnini will be speaking about trademarks, analyzing recent developments in case law on matters of current interest and offering a comparison between the US and European jurisdictions.
