SIMONA LAVAGNINI  A BOLOGNA PER IL SEMINARIO AIPPI SULLA CORTE UNITARIA DEI BREVETTI

Il name partner Simona Lavagnini in qualità di Presidente del Gruppo Formazione di AIPPI-Italia parteciperà al convegno dal titolo “Approfondimenti sulle procedure della Corte Unitaria dei Brevetti” organizzato dal Gruppo Italiano AIPPI, che si terrà in data 29 giugno 2016 a Bologna nella suggestiva cornice della Fornace Galotti “Battiferro”, sede del Museo del Patrimonio Industriale.


 

Il seminario avrà ad oggetto l’analisi di diverse novità legislative relative al nascente sistema del brevetto unitario, e sarà in particolare l’occasione per approfondire tematiche quali la gestione delle competenze territoriali, il processo di primo grado e la procedura relativa alla dichiarazione di non contraffazione davanti alla Corte Unitaria dei Brevetti.

L’introduzione del nuovo “Brevetto Unitario” e della Corte Unitaria risulta quanto mai d’attualità e presenta complessità ed incognite rilevanti soprattutto ora che, stante l’esito del recente referendum britannico, la Gran Bretagna, uno degli Stati che maggiormente ha contribuito alla nascita del nuovo sistema e che avrebbe dovuto ospitare la divisione competente per le cause relative a chimica, farmaceutica e biotecnologie, ha deciso di lasciare l’Unione Europea. Quale sarà il destino della Corte Unitaria?

È in corso di pubblicazione la sesta Edizione del Commentario breve alle leggi su Proprietà Intellettuale e Concorrenza, che rappresenta da anni un punto di riferimento per chi si occupa della materia.


 

Come nelle precedenti edizioni, il name partner  Simona Lavagnini ha contribuito al Commentario redigendo il commento ad alcune norme in materia di diritto d’autore, fra cui in particolare l’art. 16-bis relativo alla comunicazione al pubblico via satellite e ritrasmissione via cavo,  gli artt. 100, 101 e 102 relativi alla protezione del titolo, delle rubriche, dell’aspetto esterno dell’opera, degli articoli e di notizie, nonché gli artt. 102-quater e 102-quinquies in tema di misure tecnologiche di protezione e informazioni sul regime dei diritti.

Simona Lavagnini è inoltre autrice di una parte rilevante del commento alle norme in materia di banche di dati, tema su cui ha particolare esperienza, e si è quindi occupata dell’introduzione e del commento agli artt. 64-quinquies e 64-sexies in tema di tutela delle banche di dati qualificabili come opere dell’ingegno, nonché degli artt. 102-bis e 102-ter in materia di diritti del costitutore di una banca dati tutelata da diritto sui generis.


 

MS. SIMONA LAVAGNINI IS AMONG THE AUTHORS OF THE VI EDITION OF THE “COMMENT ON THE LAW OF INTELLECTUAL PROPERTY AND COMPETITION” EDITED BY WOLTER KLUWER-CEDAM

The sixth Edition of the “Comment on the law of Intellectual Property and Competition”, which for years has represented the go-to manual for practitioners, is currently being published.


As in previous editions, the name partner Ms. Simona Lavagnini has contributed to the Comment by providing an analysis of certain copyright rules, particularly art. 16-bis concerning communication to the public via satellite and cable re-transmission, arts. 100, 101 and 102 on protection of ownership, indexes, exterior appearance of a work, articles and news, as well as arts. 102-quater and 102-quinquies regarding technological protection measures and information on the rights regime.

Additionally, Ms. Lavagnini has provided significant contribution to the comment on the law regulating databases, a subject in which she is extensively experienced, and in this connection has also covered the introduction to and analysis of arts. 64-quinquies and 64-sexies concerning protection of databases that may be qualified as creative works, as well as arts. 102-bis and 102-ter which provide for the rights of the creator of a database protected by the sui generis right.


SIMONA LAVAGNINI WILL BE A SPEAKER AT THE AIPLA-AIPPI INTERNATIONAL SEMINAR

On June 17, 2016, the name partner of LGV, Ms. Simona Lavagnini, will be speaking at an international seminar “New Trends in IP Legislation and Legal Procedures: a Comparison between US and Europe”, that has been jointly organized by the European Practice Committee of AIPLA (American Intellectual Property Law Association), the Order of Industrial Property Consultants, the Italian group AIPPI (International Association for the Protection of Intellectual Property) and AICIPI (Italian Association of Consultants and Experts in Industrial Property of Entities and Companies).


The seminar will focus on an analysis of the latest US legislation and case law concerning trademarks and patents, specifically with reference to patentability of software, means-plus-function claim interpretation, trade secrets, designs and trademarks. Ms. Simona Lavagnini will be speaking about trademarks, analyzing recent developments in case law on matters of current interest and offering a comparison between the US and European jurisdictions.


SIMONA LAVAGNINI RELATRICE AL SEMINARIO INTERNAZIONALE AIPLA-AIPPI

 Il prossimo 17 giugno 2016 il name partner Simona Lavagnini parteciperà come relatrice al seminario internazionale “New Trends in IP Legislation and Legal Procedures: a Comparison between US and Europe”, organizzato congiuntamente dallo European Practice Committee dell’AIPLA (American Intellectual Property Law Association), dall’Ordine dei Consulenti in Proprietà Industriale, dal gruppo italiano dell’AIPPI (Associazione Internazionale per la Protezione della Proprietà Intellettuale) e dall’AICIPI (Associazione Italiana dei Consulenti ed Esperti in Proprietà Industriale di Enti e Imprese).


 

Il seminario avrà ad oggetto l’analisi delle novità legislative e giurisprudenziali statunitensi in materia di marchi e brevetti, con particolare riferimento alla brevettabilità del software, all’interpretazione delle rivendicazioni means-plus-function, ai segreti industriali, ai disegni ornamentali e ai marchi. Su quest’ultimo argomento verterà, in particolare, l’intervento di Simona Lavagnini, che analizzerà i recenti sviluppi giurisprudenziali sulle tematiche di maggiore interesse, soffermandosi sul confronto tra l’ordinamento statunitense e quello europeo.
